General terms and conditions of Golf Course Tespelduyn

1. Applicability

  1. These terms and conditions apply to all playing rights, annual passes and business packages.
  2. The provisions of these general terms and conditions may be deviated from only if and to the extent expressly agreed upon in writing.

2. Terms and conditions playing rights, annual passes and business arrangements (contractors)
The playing rights, annual passes and business arrangements are strictly personal and non-transferable. Third parties cannot derive any rights from them.

3. Payment options
The fees associated with playing rights, annual passes and business arrangements must be paid by the contractor within 21 days of receipt of the invoice.

4. Payment terms

  1. Each contractor shall pay playing right(s), annual pass(s) and business arrangement(s) belonging to the type of playing right(s), annual pass(s) and business arrangement(s) chosen.
  2. In case of late payment the contracting party shall be in default and may be denied access to Golf Course Tespelduyn immediately. As soon as the total arrears have been paid, the contracting party can again use the facilities to which he/she is entitled.
  3. If Golf Course Tespelduyn hands over an unpaid claim for collection, all in and out of court costs shall be borne by the defaulting contracting party.
  4. At any time, Golf Course Tespelduyn may reinstate a terminated playing right, annual pass and business package provided the overdue payment obligation has been met.

5. Duration of Playing Rights and automatic renewal

  1. Without cancellation before November 1 of the next calendar year, playing rights, annual passes and business packages are automatically renewed for 1 calendar year.
  2. Termination - cancellation of playing rights, annual passes and business packages - must be done in writing or by email before November 1 for the new calendar year. Cancellation to the membership administration via ledenadministratie@tespelduyn.nl. After confirmation of your cancellation the cancellation is final.
  3. Upon cancellation of playing rights, annual passes and business packages, all financial obligations must be fulfilled.
  4. In case of untimely cancellation, playing rights, annual passes and business arrangements are tacitly renewed. Even if the contracting party does not use the accommodation.
  5. Interim termination of playing rights, annual passes and business packages during the contract period is not possible.

6. Refund of monies
No refunds will ever be made. We advise to take out membership insurance, for example via
NGF membership insurance, travel and - cancellation insurance.

7. Termination of playing rights, annual passes and business arrangements.
Golf Course Tespelduyn may terminate a contracting party immediately in any of the following cases:

  1. Without prior warning if a contractor seriously and/or repeatedly violates the terms and/or regulations of Golf Course Tespelduyn. No refund of monies paid will follow.
  2. Without prior warning if a contractor misbehaves towards other members, employees of Golf Course Tespelduyn, for example by showing incorrect, rough or aggressive behavior. No refund of paid monies will follow.
  3. Without prior warning if a contractor intentionally causes damage to property of Golf Course Tespelduyn, employees or other contractors. No refund of monies paid will follow.
  4. With a written warning in advance, if payments resulting from the playing rights, annual passes and business arrangements, 30 days after notice of default have not been paid. This does not cancel the payment obligation.

8. Conduct of members

  1. Contractors shall not abuse the equipment or facilities provided by Golf Course Tespelduyn.
  2. Any damage to property of Golf Course Tespelduyn, caused intentionally or through identifiable fault, shall be fully reimbursed by the respective contractor.
  3. Incorrect, rough or aggressive behavior will not be accepted and Golf Course Tespelduyn is in that case entitled to take order measures. A contracting party may be temporarily denied access to the complex. Violation of these rules of conduct may also lead to termination of playing rights, annual passes and business packages.
  4. It is not permitted for the Tespelduyn Golf Course playing card to be used by persons other than the person whose name appears on the card. If an inspection reveals that a contractor is guilty of this - and thus allows another person on his/her certificate to use the facilities of Golf Course Tespelduyn, he/she will be called to account and sanctions may follow.
  5. Each contractor must be familiar with the current course regulations of Golf Course Tespelduyn.

9. Liability

  1. Contractors use the facilities of Golf Course Tespelduyn at their own responsibility and risk.
  2. Golf Course Tespelduyn excludes any responsibility by it or any of its employees for personal injury or death of a contractor or green fee player during the stay at Golf Course Tespelduyn, which may or may not involve use of the facilities provided.
  3. Golf Course Tespelduyn disclaims any liability for damages resulting from accidents, theft, fire or any other damaging events, unless due to its intent or gross negligence.

10. Other matters

  1. Golf Course Tespelduyn reserves the right to adjust the opening hours of the golf complex for cleaning, furnishing, repair, special occasions, vacations, or other compelling reasons, but will endeavor to notify contractors in advance.
  2. Golf Course Tespelduyn is entitled, if the need arises, to change and/or supplement these terms and regulations.
